>> reporter: yeah, good afternoon. after what seemed to be little or no communication at all between the suspect and police for a couple of hours, about 15 minutes ago things took a dramatic turn here. take a look behind me. you can see down the block here police are huddled in the middle of the street there. about 15 minutes ago we heard gunfire. first a short or small exchange of gunfire between the police and the suspect. then rapid fire, what sounded like a high-powered rifle going off, then loud concussion bombs if you will. then after that screaming and crying and then police running to the middle of the street and huddling where they have been for the last several minutes here. no word on the status or condition of this would be the conclusion, it seems, of what is a long morning of give and take after

tyree garland shot a firefighter this morning. they knew the manthey wanted could be armed. 38-year-old tyree garland, a convicted felon with 18 prior arrests was wanted for a federal probation violation. it seems garland knew the marshals were coming to he set a fire as a diversion. >> there was smoke billowing from inside the apartment. they immediately retracted, stepped back and called fdny. fdny responded. >> reporter: as firefighters approached, garr labeled opened fire with a possible ak-47. james hayes was shot twice. >> once through the right calf. the lieutenant is in stable condition in the hospital. >> reporter: as police set up a perimeter around the house, garland opened fire again. >> during the course of this investigation, he fired a total of four times at police. the fireman.

>> reporter: garland barricaded himself inside the house and for a while stopped communicating with police but he was talking on facebook, posting today i die. and when a friend asked what was going on, he replied, they kicked in my door and it popped off. >> we are going back and forth with him. we identified members of his well. >> reporter: larry johnson is one of those family members convinced he can get garland to surrender peacefully. >> he is like a son of mine. i don't know what happened to him. >> reporter: back live now, you can see a number of fdny and nypd members. police commissioner bratton is on the scene as well. we understand in a moment, an ambulance will be rushing down the street. we are not sure if the ambulance will be carrying the suspect or, perhaps, someone else injured during the exchange of gunfire. but, again, this has been a very long day of give and take and negotiating, of trying to

get the suspect, garland tyree to surrender peacefully. about 15 minutes ago, we heard a lot of gunfire. it was very loud and very distinct. we are waiting to find out how this all concluded. we will continue to keep you updated on air and online. live on staten island, dray clark, exanls. >> thanks, dray. obviously a fluid situation. we will go back to dray when there is an update. let's turn to kala rama outside of richmond university medical center where the firefighter was taken. what can you tell us? >> reporter: david, we just learned the name of the firefighter. 54-year-old james hayes we are told is in stable but serious condition after being shot twice as you heard from dray, once in the hip and again in the ankle here. once again, he is in serious but stable condition. all morning long he has been surrounded by firefighters as well as the fire commissioner and his wife. earlier this morning, we saw the firefighters family pulling

up to the hospital. clearly a scary situation, for them not knowing how their loved one was doing after being shots responding to a fire. he has been through quite a bit. he has been a firefighter for 31 years. shortly after the lieutenant firefighter was rushed here, detectives with lights came in. the commissioner came in and now back out here live the mayor has just come here. he is meeting with firefighters, the fire commissioner as well as that firefighter, 54-year-old james hayes who is in serious but stable condition. we will hear from the mayor in a few minutes and bring that to you later today noon, 12:30, on channel 7. live at richmond university medical center, kala rama, channel 7 eyewitness news. >> thank you, kala. as dray said a couple of minutes ago, there is activity at the scene of the stand off. we will keep you posted throughout the hour. you can read more and get a live update at abc7ny. now to the other breaking

story we have been following. a dump truck is hanging off the overpass of a highway in morris county, new jersey. it happened late this morning along route 80 near exit 28 in rocks purchase rei -- roxbury township. darla miles is live with the details on this one. darla. >> reporter: shirleen, the dump trees behind me. i want to give you a full scoop of what we are seeing. the dump truck is right there. pan to the right, you can see traffic is moving a little bit on route 80 in one lane and emergency vehicles are positioned there to remove the dump truck from a portion of this overpass. you get a better look from news copter 7. this is what it looks like above. you can see the red portion dangling on steal beams. that is an area under construction on route 8 o. let me tell you what we know so far from the new jersey state police.

at 10:00 this morning, we know the dump truck was traveling eastbound at some point it became involved in an accident. the back portion if you will, shop of the dump truck fell over on to the steel beams in the construction area. you get a better look from below. these are photos that we got from an eyewitness, chris hanson. there you can see clear through where the red part truck is resting on that overpass. but you see it's over the new jersey transit tracks but it did not fall on the new jersey transit tracks. there was debris that fell through the steel beams. the crews were removing the beams about 30 minutes ago. eyewitnesses say they heard something that felt like and sounded like a dynamite explosion and a huge amount of smoke. >> the explosion was tremendous. it has everyone in the factory nervous. >> we came outside and my

coworker said that he heard children crying. he heard a woman screaming. so, i came out a few minutes later and heard the police sirens and ambulances. >> reporter: this is what we know so far. the driver of the dump truck and driver of a second vehicle were transported to the hospital with minor injuries. the extent of their injuries we don't know. we are waiting word from new jersey state police about how the second vehicle was involved in this accident. as far as new jersey transit is concerned, service is suspended between mount arlington and hackettstown on the morris essex county line. bus service will be provided. reporting live in roxbury, darla miles, channel 7 eyewitness news. >> also in new jersey, a small earthquake shook people's nerves have morning. the 2.7 magnitude quake hit about 3:30 a.m. about 35 miles west of new york

extensive rain. >> before we go with the weather. we got an update on the the story we have been following on staten island. i believe we have the fire department at the hospital speaking on behalf of the lieutenant shot. let's listen in. >> when our members arrived, they had no reason to believe this person was armed and dangerous. there was a fire at the scene. they were communicating with the individual inside. suddenly the individual stopped talking. the smoke was building up. the lieutenant made a decision to go in and fight this fire and find the person possibly unconscious. lieutenant, in crawling in and looking for the fire and possible victim was suddenly shot twice. he was able to turn around, go past the door where the perpetrator was hiding in the bathroom. more shots were fired that missed the lieutenant.

he made his way to the entrance to the apartment. his members were able to get him out to the street. when he was removed to the street, it was found he had two wounds. both bullets entered, one the hip, one near his ankle, both exited his body. miraculously he is in stable condition and these wounds are not life threatening. he has been admitted to the hospital. his family is with him. he is as comfortable as you can be after being shot twice and i felt strange saying to him, you are lucky. you don't usually tell someone that was shot they are lucky but he is lucky that he will survive this incident. and he acted heroically. his members acted heroically, moving in from the scene and it's quite unusual. 21 years since one much our members was shot in the line of duty and these things do not occur very often.

so, we are at once troubled by the incident but happy that the outcome will be that he will rejoin his family and be hain and healthy the remainder of his names. >> what is the lieutenant's name. >> jim hayes. >> how long has he been -- >> 31 years in the department. he comes from a family -- four brothers joined the department. three are still active and he is a veteran fire lieutenant. >> 9-11 heroing too. >> a member on the seen on 9-11 and afterwards, has gone through a lot in his career, seen a lot and certainly never expected this morning to have to face something like this. >> how old is he? >> i believe he's 56 -- 53. sorry. >> two children, married, two children. a lot of loving family and friends up there with him now. >> staten island resident?

>> i believe so,ing yes. >> how would you describe his spirit? >> i think he's in very good spirits. i think he realizes that he came very close to not being with us and seeing his family, he is very happy, although i think the pain is -- he is a little uncomfortable. >> [inaudible question]. >> i have been with the department a long time, many years. i am used to getting calls for firefighters injured or killed, but not shot. so, certainly, it was a shock to me to hear that. i was in contact with the mayor since 6:00 a.m. back and forth. he just visited the firefighter now. both of us were somewhat

stunned by the fact that a firefighter would be shot in the performance of their duty. >> do you have information about the last time it happened, 21 years ago. >> quite a bit different. members were forcing a door and performing a security mistook that for a crime and fired their weapon and hit a firefighter in the foot. a little different circumstances. >> so, this lieutenant was crawling on the ground under the smoke. >> he had left his members at the door with the hose line and said i will call you when i find a victim or the fire. he was crouched down, below the smoke and that's how it occurred. >> is that routine for a lieutenant to go ahead lining that? >> yes -- like that? >> yes, it is. our officers are known to lead from the front. that's what he was doing. >> you have been listening to new york fire department

it is 12:30. brand now information on the police stand off on long island. law enforcement sources tell us that the stand off is now over and the 38-year-old suspect is dead. let's get to dray clark live at the scene in mariners harbor. dray? >> reporter: yeah, good afternoon. 38-year-old garland tyree we just learned is dead. whether or not he died as a result of a self-inflicted gunshot wound or during that heavy exchange of gunfire around 11:45 this morning, that much remains unclear. there is a significant police presence near that home where the event happened here. we noticed a number of officers standing down and also members

of the emergency services unit, the heavily armed unit walking around without their are formed gear on, another indication that the situation has reached a conclusion. this began earlier this morning when a member of the u.s. marshal's service came here to arrest garland sigh refor a federal probation violation. they noticed smoke from inside the home. they called in the fdny. as firefighters approached, garland tyree hit a lieutenant with the fdny twice. he is in stable condition. again, this situation is now reaching an end with the 38- year-old suspect garland tyree record as dead. we know the police commissioner and the mayor are planning to hold a news conference to give us more details on how this situation reached a conclusion a short time ago. live on staten island, dray clark, channel 7 eyewitness news. >> dray, thanks. a busy friday. in the 12:30 part of the show,

source of the outbreak. over a dozen other towers tested positive for legionella, the bacteria that causes the respiratory sickness. this set up by the oem out here today is designed to address emergency prepared necessary of all forms, what to do in hurricanes, water main breaks. but given what is happening in the bronx, the focus today is legionnaires. >> it's affecting people in the south bronx. we have a doctor, we have an rn from a volunteer program called medical reserve court run by the department of health and we have a public affairs person from the department of health as well who can answer real questions from a technical side of things. >> reporter: the main piece of advice they give anyone, if you exhibit respiratory symptoms to seek immediate attention. this set up will be like this until 3:00 p.m. then another legionnaires note,

resisting arrest. we have a picture to show you of a suspect in a rush hour subway groping in brooklyn. police say this man fondled a woman sleeping on an m train monday afternoon. another passenger woke up the woman and told her what happened. the suspect jumped off the train at the pacific street station. in brooklyn, police are searching for three people after a scary moment for a new mother at a hospital. police released these surveillance pictures showing the suspect's accused of walking into a patient's room at the maternity ward at nyu lute they are rail medical center in sunset park. it happened sunday. investigators say the two women and one man asked a new mother if they could take pictures with her baby. when they refused, they took -- when she refused, they took off in a white van. carbon monoxide forces people out of their rooms at the roman day hotel in holtsville.

it took about two hours to find building. a man risked his life to save his dog from a burning car in new jersey. police gave us this video of the flaming buick. the man was in a store in south brunswick when another shopper told him the car was on fire. the driver ran out to the parking lot to rescue his pug named king. the flames were so intense that it forced the evacuation of nearly several -- of several stores. the fire department eventually put the fire out. the only casualty, that 20 years old car. lawmakers in new jersey want to buy extra time for families still on the ode to recovery from -- road to recovery from superstorm sandy. they are asking for a three month damage to ask sandy related payment reviews. the deadline is september 15th. lawmakers want more time for residents to understand the process. fema is reviewing the request. a beam from one world trade center tower from september
